The Supreme Court has ruled that when the President of the United States is acting in his official capacity, he has immunity from prosecution. However, there are many details to consider, and Trump’s actions that the Biden DOJ tried to criminalize were not ruled on. The Court has sent the case back down to the District Court level for further determinations. The ruling effectively eliminates the chances Jack Smith could try Donald Trump before the November elections.
Chief Justice John Roberts wrote the Court’s majority opinion. It was a 6-3 ruling. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh joined the full opinion. Justice Barrett concurred in part, and filed a separate opinion. Justice Sonia Sotomayor wrote in dissent, joined by Justices Elena Kagan and Ketanji Jackson. Justice Jackson also filed a separate dissent.
